These Terms & Conditions (“Terms”) govern your access to and use of founderslegacyfoundation.com and our Services. By using our site or donating, you agree to these Terms and our Privacy Policy.

1. About us

   1. Founders Legacy Foundation is a nonprofit 501(c)(3) public charity. EIN: 39-4565999. Donations are tax-deductible as allowed by law.

2. Using our Services​

   1. You agree to use the Services only for lawful purposes and in compliance with these Terms. You must be 18+ (or use the Services with a parent/guardian).

3. Donations, receipts & recurring giving

   1. Donations: By submitting a contribution, you authorize Founders Legacy Foundation and its third-party payment processor to charge the payment method you provide for the amount selected. A transaction receipt or confirmation will generally be provided electronically.

   2. Tax Acknowledgments: Founders Legacy Foundation is an IRS-recognized 501(c)(3) public charity. Contributions are tax-deductible to the extent permitted by law. If goods or services are provided in connection with a contribution, any applicable value will be disclosed as required.

   3. Recurring Giving: If you enroll in a recurring giving plan offered by Founders Legacy Foundation, you authorize recurring charges to your selected payment method according to the frequency you choose at checkout. Recurring gifts will continue until canceled. You may cancel future recurring charges at any time through your account, where available, or by contacting info@founderslegacyfoundation.com. Cancellation applies only to future charges and does not refund contributions that have already been processed

4. Refunds & adjustments

   1. Charitable contributions are generally non-refundable. Founders Legacy Foundation may, at its discretion, correct duplicate transactions, processing errors, or other documented payment mistakes. Requests should be submitted to info@founderslegacyfoundation.com as soon as reasonably possible.

   2. Event registrations, tickets, merchandise purchases, sponsorships, and other transactions are subject to the refund, cancellation, or transfer terms communicated for the applicable event, product, or transaction and, where applicable, our separate Refund Policy.

5. Founders Club 2025

   1. Founders Club was a one-time 2025 launch initiative established to recognize early supporters of Founders Legacy Foundation. Founders Club is not an ongoing membership program and does not create voting, governance, ownership, or other legal rights in the Foundation.

   2. Certain individuals who participated in Founders Club 2025 may remain eligible for promotional benefits, discounts, or recognition communicated separately by the Foundation. Any such benefit is subject to the terms, eligibility requirements, expiration dates, and conditions stated in the applicable communication.

   3. Founders Legacy Foundation reserves the right to modify or discontinue promotional benefits associated with Founders Club, subject to any commitments already made to eligible participants.

6. Accounts & security (if you create an account)

   1. Keep your login confidential and notify us of any suspected unauthorized use. You are responsible for activity on your account.

7. SMS Terms

   1. Program name: Founders Legacy Foundation (FLF) SMS Updates

   2. Topics: Donations and receipts, payment or invoice reminders, programs, giving opportunities, meetings, events, impact updates, and other Foundation-related communications.

   3. Consent: By providing your mobile number and expressly opting in, you consent to receive recurring automated text messages from Founders Legacy Foundation at the number provided. Consent is not a condition of making a donation, purchasing an event ticket, or receiving Foundation services.

   4. Message frequency: Message frequency varies based on your engagement with the Foundation, including around campaigns, programs, and events.

   5. Message and data rates: Message and data rates may apply.

   6. Opt out: Reply STOP to unsubscribe from SMS communications at any time.

   7. Help: Reply HELP for assistance or contact info@founderslegacyfoundation.com.

   8. Privacy: Personal information collected through our SMS program is handled in accordance with our Privacy Policy.

   9. Compliance records: Founders Legacy Foundation may maintain records of SMS consent, opt-ins, opt-outs, and related communications as reasonably necessary for compliance and administration.

8. Intellectual property

   1. All content on the site (text, logos, graphics) is owned by FLF or used with permission and is protected by law. You may not use our marks or content without prior written consent.

9. Third-party services & links

   1. We use third-party platforms (e.g., Wix, payment processors, analytics). Your use of those services is subject to their terms and privacy policies. Links to external sites are provided for convenience; we are not responsible for their content.

10. Prohibited uses

    1. You may not: (a) breach applicable laws; (b) attempt to gain unauthorized access to the Services; (c) interfere with operation or security; (d) use bots/scrapers to harvest data; (e) misrepresent your identity or affiliation.

11. Disclaimers; limitation of liability

    1. The Services are provided “as is” without warranties of any kind. To the fullest extent permitted by law, FLF and its officers/directors/volunteers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue/data arising from or related to your use of the Services or donations.

12. Indemnification

    1. You agree to indemnify and hold FLF harmless from claims arising out of your use of the Services or violation of these Terms.

13. Governing law; venue

    1. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Venue lies in state or federal courts located in Delaware.

14. Changes to these Terms

    Founders Legacy Foundation may update these Terms from time to time to reflect changes in our programs, services, technology, legal requirements, or organizational practices. The “Last Updated” date at the top of this page identifies the most recent revision. Changes become effective when posted unless otherwise stated. Your continued use of the website or Services after an update constitutes acceptance of the revised Terms.
